Privacy Policy

This Privacy Policy (“Policy”) describes the information that we, dry-hire.com GmbH Konrad-Zuse-Platz 8, 81829 München, Registergericht München HRB225688 („dry-hire), gather on or through the service, how we use and disclose such information, and the steps we take to protect such information. By visiting the Site, or by purchasing or using our services, you accept the privacy practices described in this Policy.

Definitions

“Client” means a customer of dry-higher.

“Client Data“ means personal data, reports, addresses, and other files, folders or documents in electronic form that a User of the Service stores within the Service.

“Personal Data” means any information relating to an identified or identifiable natural person.

“Public Area” means the area of the Site that can be accessed both by Users and Visitors, without needing to log in.

“Restricted Area” means the area of the Site that can be accessed only by Users, and where access requires logging in.

“User” means an employee, agent, or representative of a Client, who primarily uses the restricted areas of the Site for the purpose of accessing the Service in such capacity.

“Visitor” means an individual other than a User, who uses the public area, but has no access to the restricted areas of the Site or Service.

§ 1 General Remarks

We collect different types of information from or through our services. The legal bases for dry-hire.com`s processing of personal data are primarily that the processing is necessary for providing our services and that the processing is carried out in dry-hire.com`s legitimate interests, which are further explained in the section “How We Use the Information We Collect” of this Policy. We may also process data upon your consent, asking for it as appropriate.

User-provided Information. When you use the Service, as a User or as a Visitor, you may provide, and we may collect Personal Data. Examples of Personal Data include name, email address, mailing address, mobile phone number, and credit card or other billing information. Personal Data also includes other information, such as geographic area or preferences, when any such information is linked to information that identifies a specific individual. You may provide us with Personal Data in various ways on our services. For example, when you register for an Account, ask for or use our services, or send us customer service-related requests.

Information Collected by Clients. A Client or User may store or upload Client Data within our services. dry-hire.com has no direct relationship with the individuals whose Personal Data it hosts as part of Client Data. Each Client is responsible for providing notice to its customers and third persons concerning the purpose for which Client collects their Personal Data and how this Personal Data is processed in or through the Service as part of Client Data.

“Automatically Collected" Information. When a User or Visitor uses the Service, we may automatically record the following data that is submitted to us by your internet browser:

·         the website you are currently visiting

·         the website from which you are visiting us (referrer URL / the website visited before)

·         date and time of access and your IP address

This “automatically collected" information may include IP address or other device address or ID, web browser and/or device type, the web pages or sites visited just before or just after using the Service, the pages or other content the User or Visitor views or interacts with on the Service, and the dates and times of the visit, access, or use of the Service.

This data and the personal data you might have submitted are saved separately.

§ 3 Inventory Data

Should data be required for constituting and executing the contractual relationship, your personal data (inventory data) will only be used for contract processing purposes. We need to know who we conclude a contract with. Without your consent, this data will not be passed on to third parties unless we are required to do so for contract processing purposes or should we be legally obliged to do so (e.g. for prosecution purposes or as an emergency response).

§ 4 Usage Data

Your personal data required to be submitted for you to make use of our services and for billing purposes (usage data) is used for contract processing purposes, such as Operation, Maintainance, Provision of all features of our services, Provision of services and information that you request, to respond to questions and Provision of support to users of the services. We are permitted to pass on account data to other service providers or third parties if settlement with the user or the law requires us to do so. Following the complete settlement of our invoice, the usage and account data will be deleted. Instead of being deleted the data will be blocked should legal or contractual retention periods prevent deletion.

Improvement

We use the information to understand and analyze the usage trends and preferences of our Visitors and Users, to improve our services, and to develop new products, services, feature, and functionality.

§ 5 Cookies

Our website uses cookies. Cookies are small text files that are dropped on your computer by your web browser and might be stored. These text files contain user-specific information that results from your using our website. We use session cookies which are deleted when you end your session. Personal data is not collected by means of our session cookies. They are designed to optimise your visit to our website.

The use of cookies can be deactivated in your web browser. With cookies being deactivated, proper functioning of all services (first and foremost registered users’ log-in) cannot be guaranteed.

§ 6 Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. (“Google”). Google Analytics uses so-called cookies, text files that are stored on your computer and facilitate an analysis of your use of the website. The information on your use of this website generated by the cookie is usually transferred to a Google server in the USA and is stored there.

Should IP anonymization be activated on this website, Google will, however, shorten your IP address within EU member states or other signatory states to the EEA Treaty beforehand. It is only in exceptional cases that your complete IP address is transferred to a Google server in the USA and shortened there. Google will use this information on behalf of this website’s host in order to analyse your use of this website, to compile reports on website activities and to provide the website host with further services related to the use of the website and the internet.

The IP address that is transferred as part of the Google Analytics service is not amalgamated with other Google data. You can prevent the storing of cookies by setting your browser accordingly. However, please note that in this case you might not be able to make use of the full scope of all functions this website offers. Please not that this website uses Google Analytics with the “_anaonymizelp()” extension and therefore only shortened IP addresses are passed on in order to prevent them from being directly linked to an individual.

§ 7 Data Security

For the purpose of safe transmission, we use a SSL certificate by thwate Inc., a VeriSign Inc. company that does encryption with up to 256 bit. The concrete encryption rate can be reduced by the browser you use.

The link to the PayPal payment service is also encrypted. Payment details such as credit card information or bank account details are neither collected nor gathered by us. Nor do we receive such data.

§ 8 Third-Party Providers

This website uses technologies supplied by the third party provider freegeoip.net, which determines the current location of the user or the device used. We use this information to automatically display the correct location-specific version of our website. The collection of location data can be revoked at any time, with immediate effect in the future, for example by installing the Add-On “NoScript” (noscript.net) for your browser.

§ 9 Your Rights

We respect your privacy rights and provide you with reasonable access to the Personal Data that you may have provided through your use of the Services. If you wish to access or amend any other Personal Data we hold about you, or to request that we delete or transfer any such information, you may contact us as set forth in the “Contact Us” section (https://dry-hire.com/en/contact-us/). At your request, we will have any reference to you deleted or blocked in our database.

You may update, correct, or delete your Account information and preferences at any time by accessing your Account settings page on the Service. Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

You may decline to share certain Personal Data with us, in which case we may not be able to provide to you some of the features and functionality of the Service.

At any time, you may object to the processing of your Personal Data, on legitimate grounds, except if otherwise permitted by applicable law. If you believe your right to privacy granted by applicable data protection laws has been infringed upon, please contact us. You also have a right to lodge a complaint with data protection authorities.

This provision does not apply to Personal Data that is part of Client Data. In this case, the management of the Client Data is subject to the Client’s own Privacy Policy, and any request for access, correction or deletion should be made to the Client responsible for the uploading and storage of such data into the Service.

§ 10 Disclosure of Information

Except as described in this Policy, we will not intentionally disclose the Personal Data or Client Data that we collect or store on the Service to third parties without the consent of the applicable Visitor, User or Client. We may disclose information to third parties if you consent to us doing so, as well as in the following circumstances:

Any information that you voluntarily choose to include in a Public Area of the Service, such as a public profile page, will be available to any Visitor or User who has access to that content.

We work with third party service providers who provide website, application development, hosting, maintenance, and other services for us. These third parties may have access to, or process Personal Data or Client Data as part of providing those services for us. We limit the information provided to these service providers to that which is reasonably necessary for them to perform their functions, and our contracts with them require them to maintain the confidentiality of such information.
